The definitions of terms used in the Terms of Service for the Sperm Donor Matching Site (hereinafter referred to as “these Terms”) are as follows.
These Terms and Conditions set forth the terms of use for this Service operated by SBC Co., Ltd. (hereinafter referred to as “the Company”).
Users shall use this Service only after agreeing to these Terms; they may not use the Service if they do not agree to these Terms.
The definitions of terms used in these Terms and Conditions are as follows:
(1) “User”: Any person who views or uses this Service
(2) “Member”: A person who has registered as a member in accordance with these Terms and Conditions
(3) “Donor”: A male member who has registered for the purpose of donating sperm
(4) “Donnie”: A female or couple member who has registered for the purpose of receiving a sperm donation
(5) “Matching”: When a donor and a recipient mutually express their intent and exchange contact information
This service is an online platform that facilitates matches between donors and recipients; it does not perform artificial insemination or provide medical services itself.
Our company is not a party to any legal relationships established between users—including sperm donation agreements, acknowledgment of paternity, child support payments, or any other matters—and will not become involved in the event of a dispute.
To register as a member, you must be at least 18 years of age.
Applicants must submit the identification documents specified by our company and provide truthful and up-to-date information.
The Company reserves the right to refuse or cancel registration based on its own screening criteria.
Membership will not be granted or will be revoked if any of the following conditions apply.
(1) Persons affiliated with antisocial groups
(2) Individuals who have previously violated the Terms of Service while using our services
(3) Married individuals (except when Donnie has registered the couple and both spouses have given their consent)
(4) Any person who may violate these Terms or applicable laws and regulations
The basic features of this service are provided free of charge, but we may introduce paid services for certain features in the future.
Details regarding the content, fees, and billing methods for paid services will be announced in advance on our website or within the app at the time of implementation and will apply accordingly.
After a match is made, the parties must enter into a written agreement regarding whether or not to proceed with the actual sperm donation, the method of donation, the number of donations, costs, acknowledgment of paternity, and the handling of the child’s last name.
Unlike donations made through medical institutions, private donations carry the risk that the donor may become the legal father (since, under Japanese law, the general principle applies unless the procedure is performed by a physician with the husband’s consent).
Our company assumes no responsibility whatsoever for any obligations regarding acknowledgment or support that may result therefrom.
While we may provide contract templates, we recommend that you have them reviewed by a lawyer or other professional.
Donors can declare on the platform that they will pay a fixed amount of child support each month for the child they have fathered.
Child support assistance is a system that provides voluntary financial support regardless of whether a legal obligation to provide support exists; it does not exclude or replace the right to claim child support under the Civil Code.
If a donor fails to make a payment, Donie may claim damages in accordance with the provisions of Article 12 (Damages), and we may suspend the donor’s account.
Users must not engage in the following actions (examples).
(1) Registration or Provision of False Information
(2) Falsification or Tampering with STD Test Results
(3) Performing acts that constitute medical practice without a license
(4) Defamation or stalking directed at the other party or a third party
(5) Brokerage or resale of offerings for financial gain
(6) Providing Benefits to Antisocial Forces
(7) Any other conduct that we deem inappropriate
Members can cancel their membership at any time by following the designated procedure within the app.
We may suspend or delete your account without prior notice in the following cases.
(1) Violation of these Terms; (2) Violation of the Prohibited Acts set forth in Article 9; (3) Any other instance where we determine that there is a significant hindrance to operations
The Company assumes no liability whatsoever for any pregnancy, childbirth, parent-child relationships, child support obligations, health issues, disputes, or other matters arising from the use of this service.
Users shall understand the risks of infectious diseases and genetic disorders associated with sperm donation and shall bear the cost of any necessary medical tests themselves.
The Company shall not be liable for any damages resulting from natural disasters, communication line failures, unauthorized access by third parties, or other acts of God.
If a user violates these Terms and causes damage to the Company, such user shall compensate the Company for all damages, whether direct or indirect (including attorneys' fees).
Even if our liability for damages is recognized, our liability shall be limited to the total amount paid to us by the user in question over the past 12 months. However, this limitation shall not apply in cases of willful misconduct or gross negligence on our part.
The intellectual property rights to all text, images, programs, and other content included in this service belong to our company or our licensors. Users may not use this content beyond the scope of personal use.
The handling of personal information shall be in accordance with our Privacy Policy, and users agree to this. When handling sensitive information, such as location data or genetic information, we will obtain separate consent.
We reserve the right to modify these Terms within reasonable limits, and any such modifications shall take effect upon their posting on our website.
In the event of significant changes, we will provide an appropriate notice period; if users continue to use the Service without raising any objections, they will be deemed to have agreed to the revised Terms of Service.
These Terms and Conditions shall be governed by the laws of Japan. In the event of any dispute between the User and the Company, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
